"Ohio’s secretary of state in 2004 was a fiercely partisan Christian named Ken Blackwell. Blackwell had hired a company called GDC Limited to run the IT systems, which had subcontracted the job to Michael Connell’s company, GovTech. Connell had in turn sub-contracted SMARTech, an IT firm based in Chattanooga, to act, it was claimed, as a backup server.
“By looking at the URLs on the Web site, we discovered that there were three points on election night when SMARTech’s computers took over from the secretary of state,” says Arnebeck. “It is during that period that we believe votes were manipulated.”
In computer jargon it is known as a man-in-the-middle attack.
“At the time I didn’t know who SMARTech were,” says IT expert Stephen Spoonamore, opening a file on his computer showing the Internet architecture map of the 2004 Ohio election. He points to a red box in the bottom right-hand corner showing SMARTech’s server.
“Then I found out: They host Rove’s e-mails. They host the RNC’s Web site. They host George Bush’s Web site.” His voice rises in disbelief.
“I go, ‘Holy shit, this is a man-in-the-middle attack! These guys have programmed the state’s computers to talk to a company with ties  to the Republican Party.’ It’s brilliant.”
With his wiry hair and designer glasses, Spoonamore looks like a character in a Tim Burton movie. A lifelong Republican, he is also one of the world’s acknowledged experts on cybersecurity, with a résumé that includes work for the U.S. armed forces and the FBI. In his spare time he has devoted thousands of hours to investigating cyberfraud in American elections. “I know I sound crazy when I talk about this stuff. No one wants to believe it. They say, ‘No one would steal an elec--tion.’ And I go, ‘Yeah, they would. And that’s exactly what they did.’ ”"

Florida's attorney general is investigating a voting-machine company merger that has voting-rights groups worried that the move will concentrate too much power over democracy in one private company.

TALLAHASSEE -- Florida Attorney General Bill McCollum is conducting an anti-trust investigation of a voting-machine company merger that would create a near-monopoly over the levers of democracy in Florida and much of the United States.

McCollum's office has issued at least six subpoenas covering every major voting-machine company as part of a civil investigation of Election Systems & Software's $5 million acquisition of Diebold Inc.'s elections division -- a merger that would give a private company too much power over the machines used to castvotes, voting-rights groups say.

``Our office engaged in this issue because anti-competitive behavior can seriously harm consumers,'' McCollum said in a written statement. ``Competitive behavior encourages the best products be available to consumers, including technology, particularly in a market as sensitive as the voting systems market.''

Under the state's 1980 anti-trust law, McCollum could persuade a court to levy fines against ES&S or prevent the company from operating in Florida. By next year, the company is expected to be the exclusive provider of voting machines and services in 65 of the 67 counties in Florida, the nation's most important swing state.

That means, under the acquisition announced Sept. 2, ES&S will provide election services to 92 percent of Florida's 11.2 million voters.

More broadly, ES&S's purchase of the competitor company gives it control of the voting machines in nearly 70 percent of the nation's precincts, according to a federal lawsuit in Delaware filed by a rival company, Hart Intercivic. The U.S. Department of Justice is conducting its own inquiry.

McCollum's investigation came to light Wednesday after eight voting rights groups sent him a letter urging him to open an inquiry -- unaware that his office had already opened its investigation Sept. 10. The first subpoena was sent out Oct. 2.

``I'm glad to hear there's an investigation. We need action now,'' sad Dan McCrea, president of the Florida Voters Foundation, one of the groups that sent the letter.

``Florida counties are negotiating their contracts now to prepare for the 2010 elections,'' McCrea said. ``They can suffer the potential damages for dealing with a monopoly now. So intervention needs to happen now.''

McCollum's spokeswoman, Sandi Copes, said the office could not comment on a pending investigation.

The subpoenas show that McCollum is searching for every type of document that the voting machine companies have, from ``pencil jottings'' to memos to canceled checks and even electronic images of websites.

Spokesmen and lawyers for ES&S, Diebold and the other voting companies could not be reached or would not comment on the case.

Documents show that the companies that received subpoenas are: ES&S, Diebold Inc., Hart-Intercivic, Sequoia Voting Systems, Scytl and Dominion Voting Systems Corporation.

In a Sept. 23 Herald/Times story about the initial concerns of the merger, ES&S offered assurances that the acquisition ``will result in better products and services for all customers and voters alike.''

But Howard Simon, executive director of the American Civil Liberties Union of Florida, said monopolies are bad for voters and consumers.

``In a monopolistic situation,'' he said, ``price goes up, quality goes down and there's almost no innovation.''

Simon said a looming issue the Legislature will face next year: how toprovide better voting equipment for disabled people who can only use touch-screen voting machines.

``We can't have separate but equal,'' said Simon, who signed Wednesday's letter along with McCrea's group and the Broward Election Reform Coalition, Common Cause, Florida Consumer Action Network, Florida Council of the Blind, Sarasota Alliance for Fair Elections and Voter Action.

In the Wednesday letter, the advocates suggested that McCollum's office cooperate with other states and the federal government, join the Delaware lawsuit filed by Hart-Intercivic and collect and submit data to the U.S. Senate Committee on Rules and Administration, which is investigating as well.

Those of us who have demanded transparent voting systems because we understand that only the ability for complete citizen oversight and transparency can effectively counter those who would game elections, have been disingenuously criticized over the years as somehow questioning the integrity of the hard-working, honest election officials out there.

The fact is, those who know anything about computer security understand that it is the insiders who are, by far, the greatest threat to security on such systems, as even the phony, GOP-operative-created Baker/Carter National Election Reform Commission determined in its final report: "There is no reason to trust insiders in the election industry any more than in other industries."

The best election officials in the country, however, will underscore that point, and agree that there is no reason any citizen should ever have to simply "trust" them.

Over the years, we've detailed the arrests and other unsavory behavior of many of the not-so-good election officials who, we were told, should simply have been trusted (our "favorite" has always been the case of Monterey CA's Tony Anchundo, who told us on air we should "trust" him, just a month or two before being arrested on 43 counts).

Well, now we've got a whole passel of still more crooked officials to add to the list. Moreover: The Kentucky officials arrested and indicted today, "including the circuit court judge, the county clerk, and election officers" of Clay County, have been charged with "chang[ing] votes at the voting machine" and showing others how to do it!

From Lexington, Kentucky's NBC affiliate this afternoon:

Five Clay County officials, including the circuit court judge, the county clerk, and election officers were arrested Thursday after they were indicted on federal charges accusing them of using corrupt tactics to obtain political power and personal gain.

The 10-count indictment, unsealed Thursday, accused the defendants of a conspiracy from March 2002 until November 2006 that violated the Racketeering Influenced and Corrupt Organizations Act (RICO). RICO is a federal statute that prosecutors use to combat organized crime. The defendants were also indicted for extortion, mail fraud, obstruction of justice, conspiracy to injure voters' rights and conspiracy to commit voter fraud.

According to the indictment, these alleged criminal actions affected the outcome of federal, local, and state primary and general elections in 2002, 2004, and 2006.

The article goes on to list some of the criminal actions listed in the indictment. Among them [emphasis added]:

While this all makes for great talk radio and sounds like fun, there is one catch: What Limbaugh encouraged Republican voters to do in Ohio was a fifth-degree felony in that state, punishable with a $2,500 fine and six to 12 months in jail. That is because in order to change party affiliation in Ohio, voters have to fill out a form swearing allegiance to that party's principles "under penalty of election falsification."

On Thursday, March 20, the Cleveland Plain Dealer reported that the "Cuyahoga County Board of Election has launched an investigation that could lead to criminal charges against voters who maliciously switched parties for the March 4 presidential primary." According to the report, "One voter scribbled the following addendum to his pledge as a new Democrat: "For one day only."

"Such an admission amounts to voter fraud," the report continued, attributing that conclusion to BOE member Sandy McNair, a Democrat. The report said the four-member board -- two Democrats and two Republicans -- had yet to vote on whether it would issue subpoenas, although Ohio's secretary of state, Democrat Jennifer Brunner, is empowered to cast tie-breaking votes when the BOE is deadlocked.

Was there a White House plot to illegally suppress votes in 2004? Is there a similar plan for the upcoming elections? This week NOW examines documents and evidence that points to a Republican Party plan designed to keep Democrats from voting, allegedly by targeting people based on their race and ethnicity with key battleground states like Ohio and Florida of particular interest. "It was a partisan, discriminatory attempt to challenge voters of color," Eddie Hailes, a senior attorney for The Advancement Project, a civil rights group, told NOW.

Was the White House involved? David Iglesias, one of the fired U.S. Attorneys, thinks so: "It's reprehensible. It's unethical, it's unlawful. It may very well be criminal." Iglesias told NOW he was repeatedly urged by his superiors at the Justice Department to investigate allegations of false voter registrations. After his investigations came up short, Iglesias said Republican officials got angry and complained to White House aide Karl Rove. Soon after Iglesias lost his job. As a result of allegations by Iglesias and others, Congress is investigating whether the White House acted unlawfully.

While Attorney General Alberto Gonzales refused to answer many questions about the controversy as he testified before the Senate this week, Iglesias told NOW he believes the White House is keeping documents from Congress to protect the Bush Administration. "That's why there has been such a circling of the wagons around Karl Rove and Harriet Miers and Sarah Taylor. I believe there to be incriminating, possibly criminally incriminating evidence contained in those e-mails and other memoranda," he said.

"The list of questionable voters that was compiled by the Ohio Board of Elections was quite similar to the vote caging lists used by the Republican campaigners. The Board of Elections sent out voter confirmation letters to targeted registered voters. The letters required the voter to return a confirmation request or have their name removed from the voter rolls. Because the confirmation letter gave the voter 60 days to respond, a voter who failed to respond to the confirmation request would still be on the voter rolls for the primary election, but would be purged prior to the general election.
The list was apparently checked by two people identified only as 'Ted' and 'Evan who' made handwritten notes in one of the columns. According to their notes, they described certain parts of Cleveland where low-income and minority voters were targeted as containing 'mixed use buildings' and 'single family apartments.' Another section said, 'looks like a parking lot ... doesn't look residential.'"

Vote caging is an illegal trick to suppress minority voters (who tend to vote Democrat) by getting them knocked off the voter rolls if they fail to answer registered mail sent to homes they aren’t living at (because they are, say, at college or at war). The Republican National Committee reportedly stopped the practice following a consent decree in a 1986 case. Google the term and you’ll quickly arrive at the Wizard of Oz of caging, Greg Palast, investigative reporter and author of the wickedly funny Armed Madhouse: From Baghdad to New Orleans—Sordid Secrets and Strange Tales of a White House Gone Wild. Palast started reporting allegations of Republican vote caging for the BBC’s Newsnight in 2004. He’s been almost alone on the story since then. Palast contends, both in Armed Madhouse and widely through the liberal blogosphere, that vote caging, an illegal voter-suppression scheme, happened in Florida in 2004 this way:

The Bush-Cheney operatives sent hundreds of thousands of letters marked “Do not forward” to voters’ homes. Letters returned (”caged”) were used as evidence to block these voters’ right to cast a ballot on grounds they were registered at phony addresses. Who were the evil fakers? Homeless men, students on vacation and—you got to love this—American soldiers. Oh yeah: most of them are Black voters.

Why weren’t these African-American voters home when the Republican letters arrived? The homeless men were on park benches, the students were on vacation—and the soldiers were overseas.

Palast supplies evidence linking Tim Griffin, then-research director for the RNC, to this caging plot; specifically, a series of confidential e-mails to Republican Party muckety-mucks with the suggestive heading “RE: caging.” The e-mails were accidentally sent to a George Bush parody site. They also contained suggestively named spreadsheets, headed “caging” as well. The names on the lists are what Palast’s researchers deemed to be homeless men and soldiers deployed in Iraq. TALLAHASSEE — Leon County Supervisor of Elections Ion Sancho asked state elections officials Friday to reexamine their voting machine certification program after computer experts conducting tests in Sancho's office hacked into Diebold machines and altered the vote count.

Gov. Jeb Bush, despite calling Sancho as a "maverick" who uses "unorthodox" methods, said earlier in the day that incoming Secretary of State Sue Cobb should "carefully" consider Sancho's complaint.

A law that will make democracy all but moot in Ohio is about to pass the state legislature and to be signed by its Republican governor.[with the lowest governor approval on record (5%-8%)]Despite massive corruption scandals besieging the Ohio GOP, any hope that the Democratic party could win this most crucial swing state in future presidential elections, or carry its pivotal US Senate seat in 2006, are about to end.House Bill 3's most publicized provision will require positive identification before casting a vote. But it also opens voter registration activists to partisan prosecution, exempts electronic voting machines from public scrutiny, quintuples the cost of citizen-requested statewide recounts and makes it illegal to challenge a presidential vote count or, indeed, any federal election result in Ohio.When added to the recently passed HB1, which allows campaign financing to be dominated by the wealthy and by corporations, and along with a Rovian wish list of GOP attacks on the ballot box, democracy in Ohio could be all but over.We should rename the Buckeye State the Diebold State and have done with it.

I've tried to point out before that we cannot expect people put in office by fraudulent means to vote to restore honest voting. As we see here, they will work to make sure voting stays dishonest. These fixed elections have put billions or trillions of dollars in the pockets of the wealthy. They will never willingly allow that to change. So live as a slave or prepare for revolution. Because democracy is over in our beloved country. We will have to fight, literally, to restore it because peaceful demonstrations do nothing. Those in power are not influenced by them.

That's after a judge today dismissed the company's request to protect it from potential criminal liability for failing to provide certain software code.
Diebold Election Systems is worried that it could be charged with a felony one day if someone determines it didN'T place all of its code aside for examination by election officials in case there's a voting mishap.

SACRAMENTO, Calif. -- A Finnish computer hacker plans to break into one of California's electronic voting machines -- but he has the state's permission.

As part of a security test, Secretary of State Bruce McPherson asked Harri Hursti to attempt to infiltrate one of the voting machines made by Diebold Election Systems.

The company is one of the nation's largest manufacturers of electronic voting systems and is trying to get its new system approved for use in California.

The tests will use a randomly selected voting machine from one of the 17 counties that currently use a Diebold system.

Hursti was asked to try to demonstrate that machines made by Diebold are vulnerable to hacker attacks and can be used to manipulate the results of an election.

The company's machines were blamed for disruptions in the March 2004 primary election in California.

The problem with this?
Hacking the Diebold machines isnt really very smart. Not when a small child could hack the tabulators and switch millions of votes in about 30 seconds. Just another case of:

The FBI says it has located 340 documents related to the bombing of the Oklahoma City federal building in 1995, documents that could reveal damaging information about what the agency and its informants knew about the mass murder plot, reports the McCurtain Daily Gazette.
According to the report in the McCurtain County, Okla., paper, the documents address the monitoring of the bombing by FBI informants, Alabama attorney Morris Dees and Dees' organization, the Southern Poverty Law Center.
Writes reporter J.D. Cash in the Gazette: 'If proven true, the ramifications of such disclosures would be far-reaching. Not only could the discovery of these documents lead to additional arrests and prosecutions in the OKC bombing case, but evidence of a cover-up of a sting operation involving the FBI and a private charity could ruin a number of careers of highly placed individuals.'
The documents are part of an extensive filing made in federal court in Salt Lake City, Utah, on Monday. A court order was obtained by Salt Lake City attorney Jesse Trentadue, the plaintiff in a Freedom of Information suit against the Oklahoma City FBI office, the Gazette reported. Trentadue has been seeking evidence in the untimely death of his brother, whose body was found beaten and slashed while the inmate awaited a parole violation hearing.
Trentadue believes his brother was tortured and killed by government agents who mistakenly thought he was involved with executed killer Timothy McVeigh and others in a string of bank robberies and the bombing of the Oklahoma City federal building.

After learning the FBI was involved in a sting operation with the Southern Poverty Law Center, Trentadue, the Gazette reports, sought a copy of two teletypes from former FBI Director Louis Freeh that discussed the undercover operation "that proved the FBI knew in advance McVeigh's plans for bombing a federal building."

The FBI initially denied it had the teletypes, but after Trentadue produced redacted copies of them, he went to court to force the FBI to cough up copies of their original un-redacted versions.

On May 5, U.S. District Court Judge Dale A. Kimball ordered the FBI to turn over un-redacted copies of two teletypes sent by Freeh to a select group of FBI field offices, including the OKBOMB task force in Oklahoma City. Kimball's order also included instructions to perform an extensive search for other records involving McVeigh, his alleged co-conspirators and informants working for the Southern Poverty Law Center.

The paper reported that, according to a Jan. 4, 1996, teletype, Freeh disclosed the Southern Poverty Law Center had an informant at the white supremacist Elohim City compound when McVeigh called the facility requesting assistance with his plans. The teletype said the call was made on April 17, 1995 – 48 hours before a truck bomb destroyed the Murrah Federal Building, killing 168 persons and injuring 500 more.

For years, the FBI has repeatedly denied the agency had any prior knowledge of the bomb plot.

The FBI now says it has found 340 documents that could also link the SPLC to McVeigh, Elohim City and members of the Aryan Republican Army.

On Monday, the FBI proposed several alternatives to turning over the documents listed in Kimball's order, saying it did not have time to comply with the judge's order to turn over the material Trentadue is seeking by June 15.

Said an agency representative: "In the past, the backlog in the FOIPA Section has been exacerbated by the high volume of administrative appeals that will require review and response by the FBI's FOIPA Section personnel. … At the present time, the FBI is involved in over 150 pending lawsuits in various federal district and appellate courts throughout the United States."

The agency further argued that revealing the elements of its intelligence-gathering operation at Elohim City would not be in the best interests of the nation.

Slagle concludes, “This is the law and it ought to be followed. Unfortunately, Secretary of State Blackwell, much like a basketball team running out the clock to protect its lead, ignored the law and prevented a meaningful recount from being conducted in the Presidential race.”

“…Blackwell instructed the 88 boards of elections that they need not conduct the recount until after Dec. 13, the day the electoral college meets in all 50 states to cast the electoral votes for President.
